Event Description:

Attend the first quarter meeting of the Accounting & Finance Council at The Victory Building, 1401 West Capitol Avenue, Little Rock, AR 72201 on Friday, March 1.

The meeting will be held from 10 am to 2:30 pm, and lunch will be sponsored by Professional Driver Agency and served while attendees network with other accounting and finance professionals in the industry and learn from experts in a workshop-style setting.  

Participants will:
  • Identify the potential legal pitfalls to avoid when implementing data analytics
  • Discuss driver per diem programs and tax impacts on trucker pay
  • Receive an overview of recent Department of Labor updates and coming changes
  • Review recent trends in industry litigation regarding driver compensation

  • ATA members who attend without registering or register but do not attend will be charged $25.

Data Analytics in the Workplace

It's not uncommon to hear that "big data" is going to change the transportation industry. But are there employment issues lurking under the surface for companies looking to adopt this new technology? Regina Young and Neemah Esmaeilpour will take a look at the data services being offered to employers and the potential legal pitfalls to avoid when implementing data analytics in the workplace.
 
Driver Recruiting and Retention
Presented by Darron Ming 
Professional Driver Agency 
In this session, Darron Ming will present data compiled over the past year by Professional Driver Agency in which over 30,000 drivers discuss why they are leaving companies. Ming will also suggest strategies to get drivers to go back to companies.  
 
Regulatory Updates & Driver Per Diem Programs 
Presented by Kayleigh Dulaney & Neemah Esmaeilpour

Having trouble keeping up with constant regulatory changes from D.C.? Come listen to Kayleigh Dulaney discuss driver per diem programs and how tax reform may impact trucker pay. Neemah Esmaeilpour will then provide a general overview of expected changes from the Department of Labor, the Social Security Administration and other agencies.
 
Trucking Litigation Trends
Presented by Greg Jones and Neemah Esmaeilpour

Recent court decisions related to driver compensation could make a big impact on the trucking industry. Greg Jones and Neemah Esmaeilpour will discuss the cases of New Prime, Inc. v. Oliveira (arbitration agreements) and Browne v. PAM Transport (sleeper birth pay) and how companies can deal with the impact of these decisions (and a few others).   
 
 
 
 
MEET THE SPEAKERS 

With an LL.M. in Taxation, Kayleigh Dulaney advises individuals, partnerships, closely held businesses and charitable organizations in a diverse range of tax-related areas including entity formation, real estate transactions, corporate transactions, mergers and acquisitions, and federal and state tax law. She regularly advises nonprofit entities in applying for, obtaining, and maintaining tax-exempt status. In 2018, Mid-South Super Lawyers named Kayleigh a "Rising Star" in the areas of tax law, estate planning and probate administration, business and corporate law, and nonprofit organizations.


Regina Young's practice centers on litigation and trial work. She defends employers in federal and state court litigation and appeals, including claims under Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act, the Family and Medical Leave Act, the Age Discrimination in Employment Act, the Fair Labor Standards Act, and state law claims involving trade secrets, non-compete agreements, arbitration agreements, wrongful discharge, the Arkansas Civil Rights Act and the Arkansas Minimum Wage Act. She has been recognized by Mid-South Super Lawyers since 2012 and was voted one of the 100 "Best Lawyers in Little Rock" by the readers of Soirée Magazine and Arkansas Business in 2016.


Neemah Esmaeilpour's practice focuses on employment law and business immigration. He represents employers and professionals in a variety of matters, including minimum wage and overtime issues, employee leave, discrimination claims, employment contracts, covenants not to compete, visa petitions, and EEOC/DOL/ICE investigations. Mid-South Super Lawyers has recognized him as "Rising Star" since 2016 in labor and employment law, and he was voted one of the 100 "Best Lawyers in Little Rock" by the readers of Soirée Magazine and Arkansas Business in 2017. Jones currently serves as outside general counsel for the Arkansas Trucking Association.
